{"id":5823,"date":"2025-12-15T10:30:23","date_gmt":"2025-12-15T13:30:23","guid":{"rendered":"https:\/\/impactocastex.com.ar\/?p=5823"},"modified":"2025-12-15T10:30:25","modified_gmt":"2025-12-15T13:30:25","slug":"presion-por-el-caso-lia-familiares-se-concentraron-en-la-previa-de-la-revision-de-pena","status":"publish","type":"post","link":"https:\/\/impactocastex.com.ar\/?p=5823","title":{"rendered":"Presi\u00f3n por el Caso L\u00eda: familiares se concentraron en la previa de la revisi\u00f3n de pena"},"content":{"rendered":"\n<p>La audiencia de revisi\u00f3n de condena se realizar\u00e1 este viernes.<\/p>\n\n\n\n<p><strong><\/strong>Familiares y amigos de L\u00eda Falc\u00f3n, la joven de 22 a\u00f1os que muri\u00f3 atropellada, se concentraron esta ma\u00f1ana frente al Centro Judicial de Santa Rosa para intensificar su reclamo de justicia, a solo cuatro d\u00edas de la audiencia clave de revisi\u00f3n de la sentencia.<\/p>\n\n\n\n<p>La movilizaci\u00f3n de este lunes tiene como objetivo presionar al Tribunal de Impugnaci\u00f3n Penal (TIP) para que incremente la pena de cinco a\u00f1os de prisi\u00f3n efectiva dictada contra el conductor, Francisco Rold\u00e1n, y para que la sentencia quede firme antes del receso judicial de enero. Actualmente, Rold\u00e1n goza de prisi\u00f3n domiciliaria.<\/p>\n\n\n\n<p>La revisi\u00f3n del TIP<\/p>\n\n\n\n<p>La audiencia de revisi\u00f3n ante el TIP est\u00e1 pautada para el pr\u00f3ximo viernes 19 de diciembre a las 9:30 horas. Este tribunal, que estar\u00e1 integrado por los jueces Filinto Rebechi, Mauricio Piombi y Mar\u00eda Eugenia Schijvarger, tiene la potestad de confirmar o modificar la pena impuesta en la Audiencia de Juicio.<\/p>\n\n\n\n<p>La querella que representa a la familia de L\u00eda Falc\u00f3n sostiene que la condena podr\u00eda ser significativamente m\u00e1s alta si el TIP recalifica la figura penal, considerando la figura de dolo eventual o, alternativamente, la culpa temeraria.<\/p>\n\n\n\n<p>Durante el juicio oral, la Fiscal\u00eda ya hab\u00eda demostrado las graves condiciones bajo las cuales Rold\u00e1n cometi\u00f3 el delito: no respetar el sem\u00e1foro, exceder la velocidad permitida y estar utilizando su tel\u00e9fono celular al momento de impactar a la joven.<\/p>\n\n\n\n<p>La sentencia inicial hab\u00eda condenado a Rold\u00e1n a cinco a\u00f1os de prisi\u00f3n efectiva y a diez a\u00f1os de inhabilitaci\u00f3n para conducir veh\u00edculos con motor.
