La decisi\u00f3n protege especialmente a personas de <b>El Salvador, Sud\u00e1n y Ucrania<\/b> mientras el tribunal analiza si concede una suspensi\u00f3n de mayor duraci\u00f3n.<\/p>\n<h1>Coalici\u00f3n logra un bloqueo temporal de la medida y mantiene el derecho a trabajar para titulares de TPS<\/h1>\n<p>Las restricciones aprobadas por el Congreso en julio de 2025 limitaron las autorizaciones laborales vinculadas con el TPS e introdujeron <b>nuevas consecuencias para los solicitantes de asilo que no pagaran las tarifas exigidas. <\/b>Seg\u00fan <a href=\"https:\/\/www.reuters.com\/legal\/government\/us-judge-blocks-trump-administration-stripping-immigrants-work-permits-2026-07-21\/\" target=\"_blank\" rel=\"\" title=\"https:\/\/www.reuters.com\/legal\/government\/us-judge-blocks-trump-administration-stripping-immigrants-work-permits-2026-07-21\/\"><i>Reuters<\/i><\/a><i>,<\/i> el juez Nathaniel Gorton <b>bloque\u00f3 temporalmente las pol\u00edticas del Uscis<\/b> que pod\u00edan retirar permisos de trabajo o acortar retroactivamente su vigencia.<\/p>\n<p>Los demandantes, representados por el grupo Democracy Forward, se opusieron a las medidas aprobadas en julio de 2025 que, por primera vez, impon\u00edan <a href=\"https:\/\/www.lanacion.com.ar\/estados-unidos\/migraciones\/asilo-en-eeuu-las-tarifas-que-ya-se-aplican-y-quedan-fijas-desde-el-29-de-junio-nid21062026\/\" target=\"_self\" rel=\"\" title=\"https:\/\/www.lanacion.com.ar\/estados-unidos\/migraciones\/asilo-en-eeuu-las-tarifas-que-ya-se-aplican-y-quedan-fijas-desde-el-29-de-junio-nid21062026\/\"><b>tarifas para solicitar asilo<\/b><\/a> y restring\u00edan la <b>autorizaci\u00f3n de empleo para personas con TPS<\/b>. Su argumento fue que el <b>Servicio de Ciudadan\u00eda e Inmigraci\u00f3n (Uscis,<\/b> por sus siglas en ingl\u00e9s) implement\u00f3 las disposiciones de manera ilegal. <\/p>\n<p>En la demanda aseguraron que se reduc\u00eda indebidamente el tiempo que los beneficiarios del <b>TPS estar\u00edan autorizados para trabajar<\/b> al aplicar de manera retroactiva las restricciones. Y es que, seg\u00fan la orden emitida en su momento por el presidente Joe Biden, las designaciones permanecen vigentes para ciudadanos de El Salvador hasta el 9 de septiembre y para Sud\u00e1n y Ucrania hasta el 19 de octubre. <\/p>\n<p>La coalici\u00f3n tambi\u00e9n expres\u00f3 que las<b> nuevas pol\u00edticas eran inv\u00e1lidas<\/b> porque el p\u00fablico nunca recibi\u00f3 notificaci\u00f3n ni tuvo la oportunidad de comentar sobre ellas antes de su adopci\u00f3n, como lo exige la Ley de Procedimiento Administrativo. <\/p>\n<h1>El juez mantiene las tarifas de asilo, pero bloquea sanciones por falta de pago<\/h1>\n<p>El juez Gorton <b>se neg\u00f3 por el momento a suspender el cobro de las tarifas para <\/b><a href=\"https:\/\/www.lanacion.com.ar\/estados-unidos\/visas-y-tramites\/permiso-de-trabajo-en-eeuu-los-tres-grupos-migratorios-que-podrian-enfrentar-mas-controles-del-dhs-nid12062026\/\" target=\"_blank\" rel=\"\" title=\"https:\/\/www.lanacion.com.ar\/estados-unidos\/visas-y-tramites\/permiso-de-trabajo-en-eeuu-los-tres-grupos-migratorios-que-podrian-enfrentar-mas-controles-del-dhs-nid12062026\/\"><b>solicitantes de asilo<\/b>.<\/a> Sin embargo, orden\u00f3 que el Uscis no pueda retirar permisos de trabajo ni imponer otras sanciones a quienes no efect\u00faen el pago mientras permanezca vigente la medida judicial.<\/p>\n<p><b>La tarifa anual de asilo contin\u00faa vigente.<\/b> El monto base establecido por la ley fue de US$100 y est\u00e1 sujeto a ajustes por inflaci\u00f3n; para el a\u00f1o fiscal 2026, el Uscis inform\u00f3 una tarifa de US$102.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/resizer.glanacion.com\/resizer\/v2\/FJDX4Y6UZFBSRJ5VNYEJGOZZZY.jpg?auth=8fd1c405a11ca9857fbddb048d86eb23249893afd49071ad21022ef292f72c03&amp;smart=true&amp;width=2000&amp;height=1333\" alt=\"La nueva norma exige a los solicitantes de asilo un pago de US$100 al a\u00f1o \" height=\"1333\" width=\"2000\" \/><\/p>\n<h1>Advierten que la decisi\u00f3n del juez sobre asilo y TPS solo es temporal<\/h1>\n<p>La orden permanecer\u00e1 vigente hasta que el juez decida si concede una suspensi\u00f3n de mayor duraci\u00f3n mientras contin\u00faa el litigio.<b> Gorton indic\u00f3 que resolver\u00e1 esa cuesti\u00f3n a m\u00e1s tardar el 5 de agosto,<\/b> pero esa decisi\u00f3n no necesariamente ser\u00e1 el fallo final sobre la legalidad de las pol\u00edticas.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/resizer.glanacion.com\/resizer\/v2\/LWGK5PWC55ALNBPANRZGRCERSU.jpg?auth=95548d7b34525a1b329856fb785c0c7c841107c4f9cbe1e8250881004bc64841&amp;smart=true&amp;width=2000&amp;height=1333\" alt=\"La decisi\u00f3n del juez que afectaba a los migrantes con TPS y asilo solo es temporal\" height=\"1333\" width=\"2000\" \/><\/p>\n<p>Con base en lo anterior, la abogada Kathia Quir\u00f3s declar\u00f3 a <i>Telemundo<\/i>: \u201cEsta decisi\u00f3n alarga la vida de los<b> permisos de trabajo de las personas con TPS<\/b> por unos d\u00edas. No es una decisi\u00f3n permanente, es algo muy temporal\u201d. La resoluci\u00f3n no restablece el<b> programa del TPS<\/b>, ni revierte la decisi\u00f3n de otras cortes de eliminarlo. <\/p>\n<p>\u200bConoce c\u00f3mo el fallo sobre el TPS y los solicitantes de
