{"id":12254,"date":"2026-02-24T15:37:46","date_gmt":"2026-02-24T18:37:46","guid":{"rendered":"https:\/\/impactocastex.com.ar\/?p=12254"},"modified":"2026-03-18T07:30:25","modified_gmt":"2026-03-18T10:30:25","slug":"la-muerte-de-nisman-declaro-en-indagatoria-la-exfiscal-viviana-fein-acusada-de-no-haber-preservado-la-escena-y-pidio-su-sobreseimiento","status":"publish","type":"post","link":"https:\/\/impactocastex.com.ar\/?p=12254","title":{"rendered":"La muerte de Nisman: declar\u00f3 en indagatoria la exfiscal Viviana Fein, acusada de no haber preservado la escena, y pidi\u00f3 su sobreseimiento"},"content":{"rendered":"<p>La exfiscal <b>Viviana Fein<\/b> declar\u00f3 este martes en <a href=\"https:\/\/www.lanacion.com.ar\/politica\/citan-a-indagatoria-a-la-exfiscal-fein-acusada-de-no-haber-cuidado-el-escenario-de-la-muerte-del-nid02122025\/\" target=\"_self\" rel=\"\" title=\"https:\/\/www.lanacion.com.ar\/politica\/citan-a-indagatoria-a-la-exfiscal-fein-acusada-de-no-haber-cuidado-el-escenario-de-la-muerte-del-nid02122025\/\">indagatoria<\/a> en los tribunales Comodoro Py, acusada por el fiscal Eduardo Taiano de<b> no haber preservado <\/b>la escena del departamento de Puerto Madero donde el fiscal <b>Alberto Nisman <\/b>apareci\u00f3 con un tiro en la cabeza, el <a href=\"https:\/\/www.lanacion.com.ar\/politica\/a-diez-anos-de-la-muerte-de-nisman-la-investigacion-apunta-al-rol-de-exespias-y-exfuncionarios-nid10012025\/\" rel=\"\" title=\"https:\/\/www.lanacion.com.ar\/politica\/a-diez-anos-de-la-muerte-de-nisman-la-investigacion-apunta-al-rol-de-exespias-y-exfuncionarios-nid10012025\/\">18 de enero de 2015<\/a>.<\/p>\n<p>Fein present\u00f3 un escrito y declar\u00f3 oralmente, al contestar todas las preguntas que le formularon el fiscal Taiano y el juez Juli\u00e1n Ercolini.<\/p>\n<p>En el texto, la exfiscal pidi\u00f3 su sobreseimiento, defendi\u00f3 su actuaci\u00f3n aquella noche y afirm\u00f3 que la acusaci\u00f3n en su contra era vaga, desprovista de especificaciones que pudieran explicar c\u00f3mo, con su acci\u00f3n u omisi\u00f3n, el curso de la investigaci\u00f3n se habr\u00eda visto afectado. <\/p>\n<p>Fein, ya jubilada, lleg\u00f3 a los tribunales minutos antes de las 10, acompa\u00f1ada de su abogado <b>Lucio Simonetti<\/b>,<b> <\/b>y a las 13.30 todav\u00eda se ultimaban los detalles de su declaraci\u00f3n. <\/p>\n<p>En el caso de la muerte de Nisman, que ocurri\u00f3 d\u00edas despu\u00e9s de haber denunciado a Cristina Kirchner por un presunto pacto con Ir\u00e1n, la investigaci\u00f3n est\u00e1 abierta. La C\u00e1mara Federal confirm\u00f3 un fallo de primera instancia que sostuvo la hip\u00f3tesis del homicidio, pero resta que el expediente sea elevado a un tribunal oral, que se haga el juicio y que se dicte una sentencia. Todav\u00eda no hay indicios sobre los presuntos autores materiales.<\/p>\n<p>Este otro expediente es paralelo e investiga presuntos desmanejos en la escena. Fein, la primera fiscal a cargo del caso,<b> <\/b>es cuestionada por el tiempo que tard\u00f3 en llegar al lugar de los hechos y por la gran cantidad de irregularidades que tuvieron lugar tras el hallazgo del cuerpo.<\/p>\n<p>\u201cComo en aquella causa no se puede, ni siquiera con el grado de probabilidad que requiere la instancia, arribar a una conclusi\u00f3n coherente acerca de lo sucedido -dijo la fiscal hoy en su escrito- <b>no puede dejar de suponerse que se pretenda buscar una respuesta a ese fracaso a partir de responsabilizar a aquellos que realizaron la investigaci\u00f3n en un primer momento<\/b>\u201d.<\/p>\n<p>\u201cDe lo contrario -a\u00f1ade- ya se habr\u00eda elevado la causa a la instancia de juicio respecto de las cinco personas procesadas\u201d. <\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/resizer.glanacion.com\/resizer\/v2\/ZB4CJEDEF5D4VNSD7L2TICV2AU.jpg?auth=99b67c61dd1f39da938f3b534fbf9455e7d0d40aa09e81e94172ccc40d5e81f9&amp;smart=true&amp;width=2000&amp;height=1125\" alt=\"El d\u00eda de la muerte de Nisman en la entrada de Le Parc de Puerto Madero\" height=\"1125\" width=\"2000\" \/><\/p>\n<p>Fein sostuvo que demor\u00f3 en llegar a la escena todo el tiempo que insume trasladarse desde Belgrano, donde resid\u00eda, hasta Puerto Madero. Remarc\u00f3, adem\u00e1s, que su presencia all\u00ed no era obligatoria y que, aun as\u00ed, concurri\u00f3. Sobre la cantidad de personas que circularon por el departamento, afirm\u00f3 que muchas de ellas hab\u00edan ingresado antes de que interviniera como funcionaria en el procedimiento.<\/p>\n<p>Entre otras cuestiones, Taiano le critic\u00f3 no haber utilizado vestimenta adecuada al entrar al departamento, que no se hayan levantado correctamente las huellas digitales, y el haber circunscripto la escena del crimen solamente al ba\u00f1o donde fue hallado Nisman, cuando debi\u00f3 haber sido todo el complejo de torres.<\/p>\n<p>Fein contrapuso en su escrito que esa idea \u201ccarece de sentido\u201d y omite las \u201cdificultades pr\u00e1cticas\u201d para llevarla a cabo. Afirm\u00f3 que todo el departamento fue revisado y que se \u201cpuso especial \u00e9nfasis en el ba\u00f1o donde se encontraba el cuerpo por esa raz\u00f3n elemental pero no puede afirmarse que no se revis\u00f3 ning\u00fan otro ambiente del departamento\u201d. <\/p>\n<p>En el caso tambi\u00e9n son investigados el exsecretario de Seguridad, <b>Sergio Berni<\/b>,<b> <\/b>su entonces colaborador, <b>Dar\u00edo Ruiz<\/b>, el exjefe de la Polic\u00eda Federal <b>Rom\u00e1n Di Santo<\/b> y el extitular de la Prefectura <b>Naval Luis Heiler<\/b>, adem\u00e1s del juez <b>Manuel de Campos<\/b>, que estaba de turno con la fiscal\u00eda de Fein.<\/p>\n<p>\u200bNeg\u00f3 responsabilidades en la escena donde muri\u00f3 Nisman y sugiri\u00f3 que su imputaci\u00f3n aparece a\u00f1os despu\u00e9s, como
